1. Definitions
”IDNA” means Identify DNA and Analyze Company Limited. “Services” means the provision of biological samples the Client provides to IDNA for the purpose of determining biological relationships. “Client” means the person(s) or legal entity that purchases Services from iDNA.
2. Services
2.1. By submitting samples or payment to IDNA, the Client agrees to the Terms and Conditions for Services.
2.2. The Services provided by IDNA are solely for the use of the Client. IDNA makes no representation, expressed or implied that the result of the Services is useful for any purpose other than the Service purchased by the Client.
2.3. In case the Client collects samples by himself, IDNA does not guarantee the samples provided shall be suitable for Services, or that Services shall provide a conclusive result. Biological samples submitted to IDNA will not be returned, except for specific requests.
2.4. For samples collected via Chain-of-Custody, IDNA rigorously follows nationally and internationally recognized standards for court-admissible test results. While iDNA test results are routinely accepted by the government, each local authority ultimately determines admissibility.
3. Payment
Payment in full is required before Services can begin. Payments can be made by cash or bank transfer.
4. Privacy policy
4.1. Only the Client who signed the order form can access the order information and results of Services. Additionally, in case the Client cannot contact IDNA to access such data, an authorised person as indicated in the second part of the order form can liaise with IDNA on behalf of the Client.
4.2. Information of tests would be archived in 3 months for normal purposes and 6 months for legal purposes. Testing reports are archived for 30 days from published dates.
5. Warranties and Indemnity
5.1. The Client warrants that he/she is legally entitled to perform any particular act either directly or indirectly in order to obtain, possess, and provide the biological samples necessary for IDNA to perform the Services purchased by the Client.
5.2. The Client shall ensure his/her family, friends, collegues, or others who are directly or indirectly involved in the results of the Services will not abuse, harass by phone, email or other means of communication or whatsoever to IDNA and her staff. The Client shall indemnify iDNA and her partners against all costs, claims, demands, expenses and liabilities of whatsoever nature that may arise from such events.
6. Disclaimers and Liabilities
The Client agrees that any and all liability of IDNA, her affiliates, her contractors, her distributors, and her suppliers shall be limited to either re-performing the Services at no cost to the Client, or refunding the amount received by iDNA for such Services.
7. Refund policy
Refunds may be considered at the discretion of iDNA and may be subject to administrative and handling fees.
